New Challenges to Democracy: The Portuguese Case

In the paper, the three authors seek to explore the main challenges posed by the rich strain of Portuguese Constitutional Court rulings on austerity measures to constitutional law doctrine, and to the separation between politics and constitutional adjudication (1). Both the implementation of budgetary rationalisation measures since 2011 and the pervasive justification of such measures as a matter of technical necessity to solve the deficit problem, have, however, also raised interesting and challenging questions relating to the very state of democracy and social rights in Portugal (2). Lastly, some aspects are discussed that relate to the quality, clarity and complexity of legislation, and its role in ensuring transparency in the exercise of public power.
Dans ce rapport, les trois auteurs visent à explorer les principaux défis posés à la doctrine du droit constitutionnel et à la séparation entre politique et contrôle constitutionnel par la riche variété d’arrêts de la Cour constitutionnelle portugaise sur les mesures d’austérité (1). La mise en œuvre de mesures de rationalisation budgétaire depuis 2011 et la justification abondante de telles mesures en tant que nécessité technique pour résoudre le problème du déficit ont toutefois aussi soulevé des questions intéressantes et stimulantes concernant l’état réel de la démocratie et des droits sociaux au Portugal (2). Enfin, sont discutés quelques points relatifs à la qualité, la clarté et la complexité de la législation, ainsi que son rôle dans la garantie de la transparence dans l’exercice du pouvoir public.
