New Challenges to Democracy

The history of humanity has shown that democracy is the best form of government from the point of view of protection of human rights and freedoms. The Republic of Armenia is among the states having a democratic form of government and many steps have been taken in order to develop it. However, democracy always needs continuous improvement. As a developing and changing institution, democracy regularly throws down new challenges to humanity. Particularly, the following questions should be a subject of discussion: - The separation of judicial and political powers; - Transparency, participation and legal certainty as constitutional imperatives; - The correlation of law and democracy.
L’histoire de l’humanité a démontré que la démocratie est la meilleure forme de gouvernement du point de vue de la protection des droits de l’homme et des libertés. La République d’Arménie est parmi les Etats ayant une forme démocratique de gouvernement et de nombreuses mesures ont été prises vers son développement. Quand même, la démocratie a toujours besoin d’amélioration continue. Etant une institution en développement et transformation, la démocratie pose régulièrement de nouveaux défis à l’humanité. Notamment, les questions suivantes devraient être le sujet des discussions: - la séparation des pouvoirs judiciaire et politique; - la transparence, la participation et la sécurité juridique en tant qu’impératifs constitutionnels; - la corrélation du droit avec la démocratie.
