Metropolises in Poland and France – A Functional Approach

The paper provides an analysis of metropolitan tasks in Polish and French legal order and attempts to categorise them. Both in Poland and France there is a noticeable trend to widen the significance of metropolis in the contemporary local government, which proves the good direction of changes. Metropolises become a necessary part of implementing public tasks on a supralocal level. The results of metropolis analysis in the functional approach indicate the differentiation of French metropolitan structures which can contribute to a new structure of the metropolis institution in Polish legal order, based on the categorisation of metropolises (from cooperation between municipalities, through metropolitan unions in the current legal form, to the metropolises with legal government status such as the Metropolis of Lyon). Thus, the paper provides substantial arguments for a broader, more inclusive discussion on metropolises in the functional approach and decentralisation of public tasks.
Cet article fournit une analyse des tâches des métropoles dans l’ordre juridique polonais et français et tente de les catégoriser. Tant en Pologne qu’en France, il existe une tendance notable à élargir l’importance de la métropole dans le gouvernement local contemporain, ce qui prouve que les changements vont dans le bon sens. Les métropoles deviennent une partie nécessaire de la mise en œuvre des tâches publiques à un niveau supralocal. Les résultats de l’analyse de la métropole du point de vue fonctionnel sont révélateurs de la diversité des structures métropolitaines françaises, qui peuvent contribuer à une nouvelle structure de l’institution de la métropole dans l’ordre juridique polonais, fondée sur la catégorisation des métropoles (coopération entre les municipalités, unions métropolitaines dans la forme juridique actuelle, métropoles ayant le statut de gouvernement légal, comme la Métropole de Lyon). Cet article fournit donc des arguments substantiels en faveur d’une discussion plus large et plus inclusive sur les métropoles dans le cadre de l'approche fonctionnelle et de la décentralisation des tâches publiques.
