SUR L'ORGANISATION DE LA JUSTICE CONSTITUTIONNELLE

Constitutional justice is no longer an instance isolated and overprotected from the influence of European Union law. Therefore, this study's objective is to address two relatively distinct questions: Is Union law authorized to intervene in the organization of the Member States' constitutional justice, and to what extent? Beyond and often irrespective thereof, which one-off interventions of Union law does one already find in the organization of constitutional justice, and what is their intended purpose? The influence of Union law on this one finds its textual basis on Articles 267 of the TFEU and 47 of the EU Charter of Fundamental Rights. The submission of constitutional justice to these two articles aims at its gradual incorporation to the European judicial system. However, a series of questions regarding the place and the role of constitutional justice in this European judicial mechanism still remain unanswered.
La justice constitutionnelle n'est plus une instance isolée et surprotégée des emprises du droit de l'Union européenne. Cette étude a donc comme objectif de répondre à deux questions relativement distinctes: Le droit de l'Union est-il habilité à intervenir dans l'organisation de la justice constitutionnelle des Etats membres et dans quelle mesure? Au-delà et souvent indépendamment de cela, quelles interventions ponctuelles du droit de l'Union rencontre-t-on déjà dans l'organisation de la justice constitutionnelle et quelle en est la finalité poursuivie? L'emprise du droit de l'Union sur celle-ci trouve son fondement textuel dans les articles 267 du TFUE et 47 de la Charte européenne des droits fondamentaux. La soumission de la justice constitutionnelle à ces deux articles a comme finalité son incorporation progressive à l'appareil juridictionnel européen. Pourtant, une série de questions concernant la place et le rôle de la justice constitutionnelle dans ce mécanisme juridictionnel européen restent encore ouvertes.
