LE DROIT PUBLIC FACE A LA CRISE ECONOMIQUE: MODIFICATIONS INSTITUTIONNELLES
ET INSTRUMENTS D'ACTION

Traditionally, the State cannot allow the economy to regulate itself in case of crisis. If it does not act, the citizens consider in fact that it does not play its protective role and that it thus abandons one of its primary functions. The current crisis has, however, led to institutional changes: the regress of the State vis-à-vis supranational institutions and, within the State, a regress of the role of the executive. However, instruments of action have not been profoundly modified. Conventional levers are still being used, they have been improved but they have not been revolutionised. At most, it is being noted, the current crisis leads to a concomitant use of numerous instruments, probably because of the seriousness of the current crisis and of the will to compensate for the impossibility of a traditional financial recovery because of the state of public finances.
Traditionnellement l'Etat ne peut laisser l'économie s'autoréguler en cas de crise. S'il n'agit pas, les citoyens considèrent en effet qu'il ne joue pas son rôle protecteur et abandonne ainsi l'une de ses fonctions primordiales. La crise actuelle a cependant conduit à des modifications d'ordre institutionnelles: la perte de place de l'Etat face aux institutions supranationales et, au sein de l'Etat, une perte du rôle de l'exécutif. En revanche, les instruments d'action n'ont pour leur part pas été profondément modifiés. Les leviers classiques sont utilisés, ils sont améliorés, mais ils ne sont pas révolutionnés. Tout au plus remarque-t-on que la crise actuelle conduit à un usage concomitant de nombreux instruments, vraisemblablement du fait de la gravité de la crise actuelle et de la volonté de compenser l'impossibilité d'une relance économique classique du fait de la situation des finances publiques.
