In recent years and in conditions of acute economic and social crisis, a crisis made all the more complex by the massive waves of transit refugees and immigrants, human rights and fundamental freedoms suffered a notable setback in Greece. With particular intensity, Greek society experienced repeated outbreaks of intensified levels of hate speech and an escalating racist violence. The chronicle reviews recent Law 4443/2016, a new legislative initiative that attempts to address the state of play on two fronts; on the one hand, the comprehensive protection and implementation of the principle of equal treatment in both the public and the private sector, and on the other, the establishment of an independent and effective mechanism for investigating arbitrary acts by enforcement agents and prison guards, with particular emphasis on racist or intolerance-motivated practices.
Au cours des dernières années et dans des conditions de crise économique et sociale aiguë, une crise rendue d’autant plus complexe par les vagues massives de réfugiés en transit et d’immigrants, les droits de l’homme et les libertés fondamentales ont subi un important recul en Grèce. La société grecque a vécu avec une intensité particulière des flambées répétées de niveaux accrus de discours de haine et une violence raciste en progression. La chronique examine la récente loi 4443/2016, une nouvelle initiative législative qui tente de faire un état des lieux sur deux fronts: d’un côté, la protection complète et application du principe d’égalité de traitement dans le secteur public et privé et, de l’autre, l’établissement d’un mécanisme d’enquête indépendant et efficace concernant les actes illégaux commis par les forces de l’ordre et les gardiens de prison, l’accent étant mis en particulier sur les pratiques racistes ou motivées par l’intolérance.
