The Danger of Constitutional Mithridatism
Fundamental Rights in Times of a Pandemic

Measures to combat the coronavirus pandemic have limited a number of fundamental rights. Here, however, lies the great danger of the gradual consolidation of a constitutional mithridatism, which will make us addicted to the idea of losing our fundamental rights for the sake of protecting superior legally protected rights. In this context, two points should be stressed: first, the recent measures are justified to protect the health of a large number of our fellow citizens, but they are an exceptional case that cannot be repeated. And, second, even in dealing with the pandemic, the rule of law sets inviolable limits. This paper intends to deal with the following questions: Can the suspension of fundamental rights in order to tackle the coronavirus pandemic threaten the health of democracy? How do we defend our legal culture?
Les mesures de lutte contre la pandémie de coronavirus ont limité un certain nombre de droits fondamentaux. Or, c’est là que réside le grand danger de la consolidation progressive d’un mithridatisme constitutionnel, qui nous accoutumera à l’idée de perdre nos droits fondamentaux au profit de la protection de droits supérieurs juridiquement protégés. Dans ce contexte, deux points méritent d’être soulignés: premièrement, les mesures récentes sont justifiées pour protéger la santé d’un grand nombre de nos concitoyens, mais elles constituent un cas exceptionnel qui ne pourra pas être répété. En second lieu, même face à la pandémie, l’Etat de droit fixe des limites inviolables. Le présent article se propose de répondre aux questions suivantes: la suspension des droits fondamentaux pour faire face à la pandémie de coronavirus peut-elle menacer la santé de la démocratie? Comment défendre notre culture juridique?
