This study is devoted to the criminal-law protection of the natural habitat in Italy. Over time some changes to the system have been introduced, but currently a general revision of the system of criminal sanctions is necessary, also after the amendment made in 2011, that introduced in the Criminal Code a provision related to the crime of destruction or deterioration of the natural habitat. The changes must mainly concern the provision of an effective system of criminal sanctions against both private individuals and companies, but also the reinforcement of the public administration, the system of authorizations, a strong limitation of new buildings given the undisputed increase in cementing in the face of the reduced, over time, housing needs.
Cette étude est consacrée à la protection pénale de l’habitat naturel en Italie. Au fil du temps, certaines modifications ont été introduites au système, mais actuellement une révision générale du système des sanctions pénales est nécessaire, également après l’introduction, en 2011, dans le Code pénal d’une disposition sur le délit de destruction ou de détérioration de l’habitat naturel. Les modifications doivent, principalement, concerner la mise en place d’un système efficace de sanctions pénales à l’encontre des individus privés et des entreprises, mais aussi le renforcement de l’administration publique, le système d’autorisations, une forte limitation des nouvelles constructions compte tenu de l’augmentation incontestée de la cimentation face à la réduction, au fil du temps, des besoins de logement.
Questo lavoro è dedicato alla tutela penale dell’habitat naturale in Italia. Nel corso del tempo sono state introdotte alcune modifiche al sistema, ma attualmente si avverte la necessità di una revisione generale del sistema delle sanzioni penali, anche dopo la modifica apportata nel 2011, che ha introdotto nel codice penale una disposizione relativa alla distruzione o deterioramento dell’habitat naturale. Le modifiche dovranno riguardare innanzitutto la previsione di un sistema efficace di sanzioni penali sia contro i soggetti privati che le società, ma anche il rafforzamento della pubblica amministrazione, il sistema delle autorizzazioni, una forte limitazione delle nuove costruzioni, atteso l’aumento incontrastato della cementificazione a fronte di esigenze abitative ridottesi nel corso del tempo.
