The news of administrative law in 2016 are related less to the understanding of the law on the organisation and function of the Administration than to the changes affected as to the ways of production of administrative law itself. The question of the means, the methods and the functions of the administrative judge is central to it. Between the renovation of the status of the administrative judges, the modernisation of the procedures before the administrative jurisdiction and the will of the Council of State to balance its control over restrictions on public freedoms in the unprecedented situation of an endless state of emergency, the administrative judge also has to develop his functions in front of the transfiguration of the administrative act rendered “adaptable” under the influence of the regulation processes. Flexibility in the acts, flexibility in the methods, flexibility in the judgments; flexibility so that nothing is upset and everything lasts. The year 2016 finally mirrored our administrative law.
L’actualité du droit administratif en 2016 apporte moins à la compréhension du droit de l’organisation et du fonctionnement de l’Administration qu’aux mutations à l’œuvre dans les modes de production du droit administratif lui-même. La question des moyens, des méthodes et de l’office du juge administratif y est centrale. Entre la rénovation du statut des magistrats administratifs, la modernisation des procédures devant la juridiction administrative et la volonté du Conseil d’Etat d’équilibrer son contrôle des restrictions aux libertés publiques dans la situation inédite d’un état d’urgence sans fin, le juge administratif doit aussi faire évoluer son office face à la transfiguration de l’acte administratif devenu “souple” sous l’influence des procédés de régulation. Souplesse dans les actes, souplesse dans les méthodes, souplesse dans les jugements ; de la souplesse pour que rien ne rompe et que tout perdure. L’année 2016 aura finalement été à l’image de notre droit administratif.
