The period 2010-2012 resulted, in the field of administrative law, in two important decisions of the Belgian Constitutional Court. One of them concerns the constitutionality of independent administrative authorities; the other the power to modulate the effects in time of the annulments pronounced by the Council of State against regulatory acts. These two decisions are crucial in edifying the Belgian administrative law. They are being analysed in this paper.
Les années 2010 à 2012 ont donné lieu dans le domaine du droit administratif à deux arrêts importants de la Cour constitutionnelle belge. L'un concerne la constitutionnalité des autorités administratives indépendantes; l'autre le pouvoir de modulation des effets dans le temps des annulations prononcées par le Conseil d'Etat à l'encontre d'actes réglementaires. Ces deux arrêts sont majeurs dans l'édification du droit administratif belge. Ils sont analysés dans la présente contribution.
