THE SPANISH FINANCIAL AND ECONOMIC CRISIS

This paper analyzes the economic and financial crisis Spain is undergoing, as well as the public measures that are being taken in order to face it. The paper presents the nature and content of these measures, the objectives pursued by them and the results achieved. Special attention is paid to the legal form adopted by these measures, the procedures for adoption and their relationship with other legislation; in particular, with the Constitution. Due to its importance and special characteristics, two different issues are dealt with independently: firstly, the reform of the Constitution in order to introduce the golden rule; secondly, the reform carried out in the financial market.
Ce rapport analyse la crise économique et financière que subit l'Espagne, ainsi que les mesures publiques qui sont prises pour y faire face. Le rapport présente la nature et le contenu de ces mesures, les objectifs poursuivis par eux et les résultats obtenus. Une attention particulière est accordée à la forme juridique adoptée par ces mesures, les procédures d'adoption et leur relation avec d'autres textes juridiques; en particulier, avec la Constitution. En raison de son importance et de ses caractéristiques spéciales, deux questions différentes sont présentées indépendamment: d'une part, la réforme de la Constitution afin d'y introduire la règle d'or; d'autre part, la réforme du marché financier.
