COMPARATIVE ANALYSIS OF THE LEGISLATIVE FUNCTION
OF THE PARLIAMENTS
OF BOSNIA AND HERZEGOVINA, SERBIA, AND MONTENEGRO

The author analyzes the legislative function of the parliaments of Bosnia and Herzegovina, Serbia, and Montenegro. He starts from the fact that these three states had the same constitutional and political history for seven decades and that they started the process of social and political transformation at the same time. Therefore, legal norms on and fulfilling the legislative functions of their parliaments must have many similarities. On the other hand, the differences in the forms of government and the political regimes have caused some different legal solutions. All segments of legislative functions are analyzed and compared in order to find similarities and differences. This analysis aims to help in improving the legal solutions and practical functioning of parliaments which are sometimes equated with being legislative rubber stamps. An institution that rubber stamps is one that automatically approves whatever is put before it, usually by a powerful leader.
